Booking and Deposits

A booking is confirmed only after a signed contract and deposit payment have been received. Deposits are non-refundable, as they secure your date and preparation for the session. Remaining balances must be paid according to your contract before the session or event.

Services

Services include maternity, newborn, family, and wedding photography, along with related products such as prints, albums, or digital galleries. Any additional services not specified in your contract must be agreed upon in writing and may incur additional fees.

Client Responsibilities

Clients must provide accurate information for booking, including dates, locations, and participant details. Children under 18 must be accompanied by a parent or legal guardian during sessions. Clients are responsible for obtaining any necessary permissions for photography at private or public locations.

Image Delivery

Final edited images are delivered digitally via secure galleries or other agreed-upon methods. Delivery timelines will be provided in your contract; we make every effort to meet deadlines but are not liable for delays due to unforeseen circumstances. We reserve the right to use images for portfolio, marketing, and social media purposes unless a written restriction has been agreed upon.

Artificial Intelligence & Digital Editing

The Company may use artificial intelligence (“AI”) assisted tools and software as part of its normal workflow, including but not limited to image culling, color correction, retouching, object removal, noise reduction, background enhancement, album design, administrative automation, and client communications. All final creative decisions and delivered images remain subject to human review and artistic discretion by the Company. AI-assisted editing will not intentionally be used to materially alter a client’s appearance, event details, or identity unless specifically requested or approved by the client. The Company retains full copyright and creative ownership of all edited works unless otherwise stated in writing. The Client acknowledges that certain digital workflow tools and third-party platforms may process image files or metadata securely for editing, organization, enhancement, backup, or delivery purposes.

Usage Rights

Clients receive a personal, non-exclusive license to use images for personal purposes only. Images may not be resold, sublicensed, or used for commercial purposes without written permission. We retain copyright ownership of all images, including the right to display, reproduce, and distribute for promotional purposes.

Cancellations and Rescheduling

Cancellation requests must be made in writing. Rescheduling is subject to availability and may require a revised contract or fee.

We are not responsible for rescheduled dates due to weather, illness, or other unforeseen circumstances.

Payments and Refunds

All payments are non-refundable unless otherwise stated in the contract. Payment methods accepted will be outlined in your contract. Late payments may result in delayed delivery of images or cancellation of services.

Liability

We take every precaution to ensure safety during sessions; however, Michelle Lea Photographie is not liable for accidents, injuries, or loss/damage of personal property during sessions or events. We are not responsible for conditions outside our control, including but not limited to weather, venue restrictions, or participant behavior.

Digital Security

We store your images and personal information securely. While we take precautions, Michelle Lea Photographie cannot guarantee 100% security of digital files once delivered or shared online.

Governing Law

These Terms and Conditions are governed by the laws of the state of Tennessee, United States. Any disputes arising from the use of our website or services will be resolved in the appropriate courts of Tennessee.

Changes to Terms

We may update these Terms and Conditions at any time. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
